These Terms and Conditions (“Terms”) govern your access to and use of FavoritesA2Z.com, its regional or local websites and directories, digital coupons, promotional offers, messaging services, and other services operated by Favorites A2Z (“Favorites A2Z,” “we,” “us,” or “our”).
By accessing or using Favorites A2Z, creating an account, claiming an offer, purchasing an eligible promotional offer, submitting information, or otherwise using our services, you agree to these Terms.
If you do not agree to these Terms, please do not use the Favorites A2Z services.

Through Favorites A2Z, consumers may discover businesses, view or claim digital offers, receive promotional communications, participate in special promotions, and interact with participating businesses.
Favorites A2Z may also provide marketing, customer engagement, reputation management, messaging, promotional, directory, and related services to participating businesses.
Unless specifically stated otherwise, Favorites A2Z is not the seller or provider of the products or services offered by participating businesses.
2. ELIGIBILITY
You must be at least 18 years old or the age of legal majority in your jurisdiction to make purchases or enter into binding transactions through Favorites A2Z.
By using Favorites A2Z, you represent that the information you provide is accurate and that you are legally permitted to use the services.
3. PARTICIPATING BUSINESSES
Businesses appearing on Favorites A2Z are independently owned and operated unless otherwise stated.
Participating businesses are responsible for their own products, services, pricing, hours, availability, customer service, representations, and fulfillment of their offers.
The inclusion of a business on Favorites A2Z does not constitute a guarantee or endorsement of that business, its products, or its services.
Favorites A2Z may remove, suspend, modify, or decline a business listing or promotion when we reasonably believe it is inaccurate, misleading, unlawful, inappropriate, expired, or inconsistent with our platform policies.
4. DIGITAL COUPONS AND OFFERS
Favorites A2Z may provide digital coupons, discounts, incentives, promotional offers, customer-acquisition offers, loyalty offers, bounce-back offers, and other promotions.
Each offer may have its own terms, including:
• expiration dates;
• minimum purchase requirements;
• eligible products or services;
• participating locations;
• redemption limits;
• one-time-use restrictions;
• exclusions;
• blackout dates; and
• other conditions established by the participating business.
The specific terms displayed with an offer are incorporated into these Terms.
Consumers are responsible for reviewing an offer's conditions before claiming, purchasing, or redeeming it.
Offers have no cash value unless specifically stated otherwise and may not be combined with other promotions unless permitted by the participating business.
5. DIGITAL COUPON REDEMPTION
Some Favorites A2Z offers use electronic redemption technology.
A participating business may be able to determine when an offer has been redeemed and may record information associated with the redemption, such as the date of redemption or transaction information.
Consumers may be required to present the digital offer on a mobile device at the time of purchase.
Offers designated as one-time-use offers may become invalid immediately after redemption.
Attempting to duplicate, manipulate, reproduce, transfer, or fraudulently redeem a single-use offer may result in cancellation of the offer or restriction of access to Favorites A2Z.
Consumers should not mark an offer as redeemed until instructed to do so by the participating business when the applicable redemption process requires merchant verification.
6. PROMOTIONAL CERTIFICATES AND PURCHASED OFFERS
Favorites A2Z may occasionally make promotional certificates, discounted certificates, or other paid promotional offers available for purchase.
For example, a consumer may have the opportunity to purchase a promotional offer that provides a stated amount of purchasing value at a participating business for a discounted price.
Each purchased promotion is subject to the specific terms presented at the time of purchase.
Favorites A2Z may provide the technology, marketing, payment processing, or promotional platform used in connection with the transaction. The participating business remains responsible for providing the underlying goods or services except where expressly stated otherwise.
Any expiration dates, refund rights, promotional-value limitations, or other restrictions will be applied subject to applicable federal, state, and local law.
Nothing in these Terms is intended to waive any consumer right that cannot legally be waived.
7. OFFER AVAILABILITY
Offers may be limited by quantity, time, geography, participating location, inventory, or other conditions.
Favorites A2Z does not guarantee that any particular offer will remain available.
An offer may be modified, suspended, withdrawn, or replaced when reasonably necessary, subject to applicable law and any rights associated with previously purchased offers.
8. INFORMATION PROVIDED WHEN CLAIMING AN OFFER
When claiming an offer, registering, purchasing a promotion, entering a contest, or otherwise interacting with Favorites A2Z, you may be asked to provide information such as your name, email address, or mobile telephone number.
You agree to provide accurate information.
Our collection and use of personal information is also governed by the Favorites A2Z Privacy Policy.
9. EMAIL AND TEXT MESSAGE COMMUNICATIONS
Where you expressly consent, Favorites A2Z and/or the participating business identified in the applicable signup or offer may send you marketing or promotional communications by email or text message.
Consent to receive marketing text messages is not a condition of purchasing goods or services.
Message frequency may vary.
Message and data rates may apply.
You may opt out of promotional text messages at any time by replying STOP to the applicable message. You may receive a confirmation message after opting out.
For text messaging assistance, reply HELP where supported or contact Favorites A2Z through the contact information provided on our website.
You may unsubscribe from promotional emails by using the unsubscribe link included in the applicable email.
Your consent applies only as described at the point where the consent is obtained. Favorites A2Z does not interpret a consumer's consent as unlimited permission for unrelated businesses to send marketing communications.
Transactional or service-related communications may still be sent when permitted by law even if you opt out of marketing communications.
10. BUSINESS-SPECIFIC COMMUNICATIONS
When a consumer specifically requests an offer from, registers for promotions from, or otherwise provides consent relating to a participating business, the consumer may receive communications associated with that business as described in the applicable consent disclosure.
Participating businesses are required to use consumer information and messaging services in accordance with applicable laws, regulations, carrier requirements, and Favorites A2Z policies.
11. FAVORITES A2Z COMMUNICATIONS
Consumers may separately have the opportunity to join a Favorites A2Z promotional list or community and receive information regarding participating businesses, local offers, special promotions, events, or other Favorites A2Z content.
Where separate consent is required by law or platform policy, joining a business-specific promotional list does not automatically enroll a consumer in unrelated marketing programs.
12. BUSINESS LISTINGS
Favorites A2Z attempts to maintain useful and accurate information regarding participating businesses.
However, business information—including hours, addresses, menu items, prices, services, availability, and other details—may change.
Consumers should confirm information directly with a business when it is important to a purchasing decision.
13. REVIEWS AND REPUTATION FEATURES
Favorites A2Z may provide features that allow consumers to provide feedback regarding their experience with participating businesses.
Users agree not to submit content that is knowingly false, defamatory, threatening, unlawful, fraudulent, obscene, discriminatory, or otherwise violates the rights of another person or entity.
Favorites A2Z reserves the right to moderate or remove content when reasonably necessary to protect users, businesses, the platform, or applicable legal rights.
Favorites A2Z does not guarantee any particular review score, rating, or business outcome.
14. USER CONDUCT
You agree not to:
• misuse or attempt to manipulate an offer;
• redeem an offer more times than permitted;
• create fraudulent accounts;
• provide false information;
• interfere with the operation or security of the website;
• scrape, copy, harvest, or systematically collect platform information without authorization;
• attempt to gain unauthorized access to Favorites A2Z systems;
• use the platform for unlawful purposes;
• impersonate another person or business; or
• use Favorites A2Z in a manner that infringes the rights of another party.
Favorites A2Z may restrict or terminate access for suspected fraud, abuse, unlawful activity, or material violation of these Terms.
15. INTELLECTUAL PROPERTY
The Favorites A2Z name, logo, website design, platform content, graphics, promotional materials, software, and other original materials are owned by or licensed to Favorites A2Z and are protected by applicable intellectual-property laws.
Participating businesses retain ownership of their respective names, logos, trademarks, photographs, and other proprietary materials.
Businesses that provide materials to Favorites A2Z grant Favorites A2Z permission to use those materials as reasonably necessary to provide, promote, demonstrate, and market the applicable Favorites A2Z services, subject to any separate agreement between Favorites A2Z and the business.
16. THIRD-PARTY SERVICES
Favorites A2Z may use or link to third-party services for functions such as payment processing, messaging, maps, websites, social media, analytics, or other technology.
Favorites A2Z is not responsible for the independent operation, privacy practices, availability, or content of third-party services.
Your use of a third-party service may also be governed by that provider's terms and policies.
17. PAYMENT PROCESSING
Payments made through Favorites A2Z may be processed by a third-party payment processor.
By submitting payment information, you authorize the applicable charges associated with your transaction.
Favorites A2Z does not guarantee that every payment transaction will be accepted or successfully processed.
Suspected fraudulent transactions may be canceled, refunded, or investigated as permitted by law.
18. REFUNDS
Refund eligibility for a purchased promotion will depend on the terms presented with the applicable offer and applicable law.
If a participating business closes, refuses to honor a valid purchased offer, or otherwise becomes unable to fulfill an obligation, consumers should contact Favorites A2Z so that we can review the situation.
Nothing in this section limits refund or consumer-protection rights provided by applicable law.
19. CONTESTS, GIVEAWAYS, AND SPECIAL PROMOTIONS
Favorites A2Z may occasionally conduct contests, drawings, giveaways, or other special promotions.
Such promotions may be governed by separate Official Rules or additional terms. If those rules conflict with these Terms regarding a specific promotion, the promotion-specific rules will control.
No purchase will be required where prohibited by law.
20. NO GUARANTEE OF RESULTS
Favorites A2Z provides marketing, promotional, discovery, engagement, and related technology and services.
We do not guarantee that use of Favorites A2Z will produce any particular level of sales, revenue, customer acquisition, customer retention, reviews, website traffic, leads, redemptions, or other business results.
Results depend on numerous factors outside Favorites A2Z's control.
21. DISCLAIMER OF WARRANTIES
To the fullest extent permitted by law, Favorites A2Z and its services are provided on an “as is” and “as available” basis.
Favorites A2Z does not warrant that the website or services will always be uninterrupted, error-free, secure, or available.
We do not make warranties regarding the quality, safety, legality, availability, or suitability of products or services provided by independently operated participating businesses.
Nothing in these Terms excludes warranties or protections that cannot legally be excluded.
22. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, Favorites A2Z and its owners, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the platform.
Favorites A2Z is not responsible for personal injury, property damage, dissatisfaction, loss, or other claims arising from products or services independently provided by participating businesses, except to the extent liability cannot legally be excluded.
Nothing in these Terms limits liability that applicable law prohibits us from limiting.
23. INDEMNIFICATION
To the extent permitted by law, business users agree to indemnify and hold Favorites A2Z harmless from third-party claims arising from the business user's products, services, advertisements, offers, representations, unlawful messaging activity, infringement of third-party rights, or violation of these Terms.
Additional indemnification obligations applicable to Favorites A2Z clients may be contained in the applicable Advertiser or Client Agreement.
24. BUSINESS CLIENTS
Businesses purchasing Favorites A2Z marketing or promotional services may be required to enter into a separate Advertiser Agreement, Client Agreement, Order Form, or similar agreement.
That agreement governs matters such as subscription pricing, setup fees, billing, service levels, cancellations, database access, promotional programs, messaging services, and other business-client obligations.
If a separate signed business agreement conflicts with these website Terms regarding the business's paid services, the signed business agreement will control with respect to those services.
25. PRIVACY
Your privacy is important to us.
Our collection, use, storage, and disclosure of personal information is governed by the Favorites A2Z Privacy Policy.
The Privacy Policy should be reviewed together with these Terms.
26. SECURITY
Users are responsible for maintaining the confidentiality of their account credentials, if applicable.
Notify Favorites A2Z promptly if you believe your account or personal information has been compromised.
Although Favorites A2Z uses reasonable measures intended to protect its services, no internet-based service can guarantee absolute security.
27. SERVICE CHANGES
Favorites A2Z may add, remove, modify, improve, or discontinue features of its services.
We may also update these Terms periodically.
Material changes will become effective as provided in the updated Terms and in accordance with applicable law.
The current version will be posted on FavoritesA2Z.com with an updated “Last Updated” date.
28. TERMINATION OR SUSPENSION
Favorites A2Z may suspend or terminate access to the platform for fraud, abuse, security threats, unlawful conduct, material violations of these Terms, or other legitimate business or legal reasons.
Termination of platform access does not eliminate obligations or rights that accrued before termination.
29. GOVERNING LAW
These Terms are governed by the laws of the State of Ohio, without regard to conflict-of-law principles, except where federal law or another applicable law controls.
30. DISPUTES
Before filing a formal legal claim relating to Favorites A2Z, you agree to make a reasonable effort to contact Favorites A2Z and attempt to resolve the dispute informally.
Any additional dispute-resolution, arbitration, venue, or class-action provisions should be interpreted and enforced only to the extent permitted by applicable law.
Any mandatory arbitration or class-action waiver applicable to business clients may also be established in the applicable Advertiser or Client Agreement.
31. SEVERABILITY
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
32. NO WAIVER
Failure by Favorites A2Z to enforce any provision of these Terms does not constitute a waiver of that provision or any other right.
33. ENTIRE AGREEMENT
These Terms, together with the Privacy Policy, any offer-specific terms, applicable promotional rules, and any separate agreement entered into between Favorites A2Z and a business client, constitute the applicable agreement governing use of the Favorites A2Z services.

Registration or appointment details

You agree to provide accurate information.
Our collection and use of personal information is governed by the Favorites A2Z Privacy Policy.
Providing contact information does not automatically constitute consent to receive recurring marketing text messages.
9. EMAIL AND TEXT MESSAGE COMMUNICATIONS
Favorites A2Z and participating businesses may provide email and SMS/text communications associated with requested services, transactions, events, and authorized marketing programs.
Depending on the applicable program, communications may include:
Coupon and promotional offer information
Loyalty and customer-retention offers
Webinar registration confirmations and reminders
Webinar access instructions
Demonstration and consultation confirmations
Appointment reminders
Responses to inquiries
Requested service information
Authorized follow-up marketing and promotional communications
Where required, marketing text messages will be sent only after appropriate consent has been obtained.
Consent to receive marketing text messages is not a condition of purchasing goods or services.
Message frequency varies. Message and data rates may apply.
You may opt out of promotional text messages by replying STOP to an applicable message.

We will also honor other legally valid requests to revoke messaging consent.

Consent to receive communications from one participating business does not automatically authorize unrelated businesses to send marketing messages.
11. FAVORITES A2Z COMMUNICATIONS
Consumers may have the opportunity to join a Favorites A2Z promotional list and receive information regarding participating businesses, local offers, special promotions, events, and other Favorites A2Z content.
Prospective business clients may register for webinars, request demonstrations, schedule consultations, or request information regarding Favorites A2Z services.
Favorites A2Z may communicate with these individuals regarding their registrations, appointments, inquiries, and requested services.
Additional marketing communications, including recurring promotional SMS messages, will be provided only when appropriately authorized.
Where separate consent is required, participating in a webinar or requesting a demonstration does not automatically enroll an individual in unrelated marketing programs.
12. BUSINESS LISTINGS
Favorites A2Z attempts to maintain useful and accurate information regarding participating businesses.

Favorites A2Z may moderate or remove content when reasonably necessary to protect users, businesses, the platform, or applicable legal rights.
Favorites A2Z does not guarantee any particular review score, rating, or business outcome.
14. USER CONDUCT
You agree not to:
Misuse or manipulate an offer
Redeem an offer more times than permitted
Create fraudulent accounts
Provide false information
Interfere with website operations or security
Scrape, copy, harvest, or systematically collect platform information without authorization
Attempt unauthorized access to Favorites A2Z systems
Use the platform for unlawful purposes
Impersonate another person or business
Infringe the rights of another party
Favorites A2Z may restrict or terminate access for suspected fraud, abuse, unlawful activity, or material violations of these Terms.
15. INTELLECTUAL PROPERTY
The Favorites A2Z name, logo, website design, platform content, graphics, promotional materials, software, educational materials, webinar presentations, course content, and other original materials are owned by or licensed to Ohio Excel LLC or its applicable licensors and are protected by intellectual-property laws.
Unless expressly authorized, users may not reproduce, distribute, resell, publish, or commercially exploit proprietary Favorites A2Z materials.
Participation in a webinar or purchase of educational content does not transfer ownership of intellectual-property rights.
Educational materials are provided for authorized personal or internal business use, subject to any additional purchase or licensing terms.
Participating businesses retain ownership of their respective names, logos, trademarks, photographs, and other proprietary materials.
Businesses providing materials to Favorites A2Z grant permission to use those materials as reasonably necessary to provide, promote, demonstrate, and market the applicable services, subject to separate agreements.
16. THIRD-PARTY SERVICES
Favorites A2Z may use or link to third-party services for payment processing, messaging, webinar hosting, scheduling, maps, websites, social media, analytics, and other technology functions.
Favorites A2Z does not control the independent operation, privacy practices, availability, or content of third-party services.
Your use of third-party services may also be governed by their terms and policies.
17. PAYMENT PROCESSING
Payments made through Favorites A2Z may be processed by third-party payment processors.
By submitting payment information, you authorize the applicable charges associated with the transaction and the terms disclosed at checkout.
Favorites A2Z does not guarantee that every payment transaction will be accepted or successfully processed.
Suspected fraudulent transactions may be canceled, refunded, or investigated as permitted by law.
Recurring business-service subscriptions are governed by the applicable purchase disclosures and business-client agreement.
18. REFUNDS
Refund eligibility for purchased promotions, products, or services depends on the terms presented with the applicable purchase and applicable law.
If a participating business closes, refuses to honor a valid purchased offer, or otherwise becomes unable to fulfill an obligation, consumers should contact Favorites A2Z for review.
Refund and cancellation provisions for business-client subscriptions or educational products may be established in their applicable purchase terms or separate agreements.
Nothing in this section limits refund or consumer-protection rights provided by law.
19. CONTESTS, GIVEAWAYS, AND SPECIAL PROMOTIONS
Favorites A2Z may conduct contests, drawings, giveaways, and other special promotions.
Such promotions may be governed by separate Official Rules or additional terms.
If promotion-specific rules conflict with these Terms regarding that promotion, the promotion-specific rules will control.
No purchase will be required where prohibited by law.
Participation may be subject to eligibility, geographic, age, entry-limit, and other conditions disclosed in the applicable Official Rules.
20. NO GUARANTEE OF RESULTS
Favorites A2Z provides marketing, promotional, discovery, engagement, educational, and related technology and services.
We do not guarantee that using Favorites A2Z services, participating in webinars, implementing educational recommendations, or purchasing business-client services will produce any particular level of:
Sales or revenue
Customer acquisition
Customer retention
Reviews or ratings
Website traffic
Leads or conversions
Coupon redemptions
Other business results
Results depend on numerous factors outside Favorites A2Z's control.
Examples, case studies, projections, and educational illustrations do not constitute guarantees of future performance.
21. DISCLAIMER OF WARRANTIES
To the fullest extent permitted by law, Favorites A2Z services are provided on an "as is" and "as available" basis.
Favorites A2Z does not warrant that its websites, technology, webinars, or services will always be uninterrupted, error-free, secure, or available.
We do not make warranties regarding the quality, safety, legality, availability, or suitability of products or services provided by independently operated participating businesses.
Nothing in these Terms excludes warranties or protections that cannot legally be excluded.
22. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, Ohio Excel LLC, operating as Favorites A2Z, and its owners, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the platform or services.
Favorites A2Z is not responsible for personal injury, property damage, dissatisfaction, loss, or other claims arising from products or services independently provided by participating businesses, except to the extent liability cannot legally be excluded.
Nothing in these Terms limits liability that applicable law prohibits us from limiting.
23. INDEMNIFICATION
To the extent permitted by law, business users agree to indemnify and hold harmless Ohio Excel LLC, operating as Favorites A2Z, from third-party claims arising from the business user's products, services, advertisements, offers, representations, unlawful messaging activity, infringement of third-party rights, or violation of these Terms.
Additional indemnification obligations may be established in an applicable Advertiser Agreement or Client Agreement.
24. BUSINESS CLIENTS
Businesses purchasing Favorites A2Z marketing, promotional, educational, or related services may be required to enter into a separate Advertiser Agreement, Client Agreement, Order Form, or other applicable agreement.
These agreements may govern:
Subscription pricing and recurring billing
Setup fees
Service descriptions and included features
Messaging allowances and usage charges
Billing and payment obligations
Cancellations and refunds
Database access and customer information
Promotional programs
Reputation management services
Support and service levels
Other business-client obligations
If a separate business agreement conflicts with these website Terms regarding paid business services, that agreement will control for those services.
25. PRIVACY
Our collection, use, storage, retention, and disclosure of personal information is governed by the Favorites A2Z Privacy Policy.
The Privacy Policy should be reviewed together with these Terms.
26. SECURITY
Users are responsible for maintaining the confidentiality of their account credentials, where applicable.
Notify Favorites A2Z promptly if you believe your account or personal information has been compromised.
Although Favorites A2Z uses reasonable measures intended to protect its services, no internet-based service can guarantee absolute security.
27. SERVICE CHANGES
Favorites A2Z may add, remove, modify, improve, or discontinue features of its services.
We may also update these Terms periodically.
Material changes will become effective as provided in the updated Terms and in accordance with applicable law.
The current version will be posted on FavoritesA2Z.com with an updated "Last Updated" date.
Changes to paid business-client services remain subject to applicable agreements and legal requirements.
28. TERMINATION OR SUSPENSION
Favorites A2Z may suspend or terminate access to the platform for fraud, abuse, security threats, unlawful conduct, material violations of these Terms, or other legitimate business or legal reasons.
Termination of platform access does not eliminate rights or obligations accrued before termination.
Business-client subscription cancellation and termination provisions may be governed by separate agreements.
29. GOVERNING LAW
These Terms are governed by the laws of the State of Ohio, without regard to conflict-of-law principles, except where federal law or another applicable law controls.
30. DISPUTES
Before filing a formal legal claim relating to Favorites A2Z, you agree to make a reasonable effort to contact Favorites A2Z and attempt to resolve the dispute informally, except where applicable law permits or requires otherwise.
Nothing in these Terms prevents a user from exercising rights that cannot legally be waived.
Separate dispute-resolution provisions may apply to business clients under an executed Advertiser Agreement or Client Agreement.
31. SEVERABILITY
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain effective to the fullest extent permitted by law.
32. NO WAIVER
Failure by Favorites A2Z to enforce any provision of these Terms does not constitute a waiver of that provision or any other right.
33. ENTIRE AGREEMENT
These Terms, together with the Privacy Policy, applicable offer-specific terms, promotional rules, purchase terms, and any separate agreement entered into between Favorites A2Z and a business client, constitute the applicable agreement governing use of Favorites A2Z services.
